The Districts That Govern Orlando

One County, Two Sets of Criteria, and a Line That Is Not on the Street Map

Florida runs one statewide environmental resource permit rule, Chapter 62-330 of the Florida Administrative Code, and it reaches every corner of the state. The design and performance criteria a stormwater system actually has to satisfy are not in that rule. They are in the applicant handbook, and each water management district adopts its own.

In most of Florida that means naming one district and getting on with it. In Orlando it does not, because the Department of Environmental Protection lists the same two counties under two different districts. Orange and Osceola both appear in the St. Johns River district and in the South Florida district, each time as portions of. The county is split, and so is the criteria set.

Where the Central Florida Boundaries Fall

  • St. Johns River district: Seminole, Brevard, Volusia and Flagler in full, plus portions of Orange, Osceola, Lake, Marion and others
  • South Florida district: portions of Orange, Osceola, Okeechobee, Polk, Highlands and Charlotte, alongside the counties it holds in full further south
  • Southwest Florida district: portions of Lake, Marion and Polk, which is how a third district reaches the western edge of the Orlando region
Three districts have a claim somewhere in the greater Orlando area. Which one governs a given parcel is a records question, not something the address or the zip code will answer.

Why That Changes the Work

District boundaries follow water, not politics. They run along basin divides, which do not respect section lines, city limits or subdivision plats. A developer who did a project in south Orange County and a project near the Seminole line may have worked under two different handbooks without ever being told so.

The St. Johns River district also administers its own chapters in the Florida Administrative Code under Division 40C. Rule 40C-4.091, Publications Incorporated by Reference, effective June 28, 2024, is what pulls the applicant handbook into the rule. Those chapters are district rules. They do not apply on the South Florida side of the same county.

So the first question on an Orlando site is not what the client wants to build. It is which district the parcel sits in, and which basin inside that district.

The sentence this page is built around. A stormwater design approved on one side of the district line in Orange County is not automatically approvable on the other side of it, for the same building, on the same soil, under the same statewide rule. The rule did not change. The handbook that fills in its numbers did. Establishing which one governs, before anything is drawn, is most of what separates a permit from a resubmittal.

The Local Layer

Clearing the district is necessary and it is not sufficient. City and county land development codes sit on top of the state program and they are frequently stricter. Where a local requirement exceeds the state criteria, the local requirement is the criteria.

The Orlando metro is not one jurisdiction. A project may sit inside the City of Orlando, in unincorporated Orange County, in Osceola or Seminole County, or in one of the surrounding municipalities. Each maintains its own engineering standards, submittal requirements and review process, and they do not move together.

What the Local Layer Usually Governs

  • Finished floor elevation, which is often set locally rather than by the state minimum
  • Treatment standards where the local number exceeds the district number
  • The allowable discharge point, and whether the receiving system will accept the flow
  • Landscape and buffer areas that compete with retention area for the same ground

The most expensive civil mistake in this market is not a calculation error. It is designing to one authority and discovering a second one late.

Redevelopment Is Its Own Problem Here

A great deal of Orlando work is redevelopment rather than raw land. That means an existing permitted system, built to criteria that may be decades old, with obligations still attached to it, sitting under a project that has to meet current requirements.

What was built is also frequently not what was approved. Grades get adjusted in the field, inlets get relocated, swales get filled during a landscape renovation, and none of it appears on the record drawing.

The Diagnosis

Why an Orlando Site That Ponds Is Four Different Problems

Standing water in the same place after every storm looks like one problem and is usually one of four. They produce the same symptom and they do not share a repair, which is why the diagnosis is worth more than the fix.

The system is undersized for what is there now. Impervious area was added, a basin was filled, a pool deck or an addition went in, or the criteria have since been tightened. The system is doing what it was built to do and what it was built to do is no longer enough.

The system is the right size and has lost its capacity. A pond silted in, a control structure with a blocked orifice, an underdrain that has clogged, a swale regraded by twenty years of mowing. This is the cheapest of the four and the one most often skipped, because maintenance is the line item nobody wants to fund.

The water is arriving from somewhere else. Runoff concentrating from a neighboring parcel that regraded, a shared system that was never as available as the original design assumed, or a receiving ditch at capacity. Nothing done inside the property line fixes this, and a great deal of money gets spent inside the property line trying.

It is not stormwater at all. Seasonal high groundwater surfacing in a low spot, a leaking service line, irrigation overrun, or a perched condition over a confining layer. These get treated as drainage failures regularly, and the repair costs a fraction of a new system.

We give the answer the evidence supports, including when the answer is that the system is adequate and the problem is upstream, downstream or in the ground, because the alternative is an expensive fix to something that was never broken.

When Basic Plans Are Not Enough

Some Orlando projects need more than a standard set of drawings. That is especially true when drainage, grading, utility layout, soil behavior, existing improvements and permitting all overlap on the same parcel.

The civil problems we get called to look at in this market are rarely calculation errors. They are criteria errors.
