Broward is the other half of the High Velocity Hurricane Zone, and being inside it is where the similarity to Miami-Dade ends.

Fort Lauderdale is built around water that is held back rather than water that is simply nearby. The canal and finger island network that defines the city means most waterfront structures here sit behind a seawall, and that seawall is now a regulated structural element with an elevation requirement and a deadline attached to it.

Your Seawall Now Has a Required Height and a Date

This is the single largest thing that separates structural work in Broward from structural work anywhere else in Florida, and most owners have not caught up to it. Broward County adopted a regional tidal flood barrier standard, carried in the Broward County Code of Ordinances at Chapter 39, Article XXV. Under Section 39-407, all new, substantially repaired or substantially rehabilitated tidal flood barriers have to reach a minimum elevation of five feet NAVD88.

There is a transition provision, and it is the part worth understanding. An application submitted before January 1, 2035 may build to four feet NAVD88, but only if the barrier is designed and constructed to accommodate a minimum elevation of five feet NAVD88 by January 1, 2050. That is not a grace period. It is a requirement that a wall built today be engineered now for a height it will be raised to later, which changes the section, the embedment and the tieback design rather than just the cap elevation.

The ordinance was adopted as a model code on March 31, 2020, implementing the county policy adopted earlier that year, and municipalities across Broward were required to adopt local implementing ordinances. Which means the specific wording, the permitting path and the enforcement posture vary by city even though the elevation does not. We confirm the version the authority having jurisdiction actually enforces for the property before we design anything.

The practical consequence is that a seawall in Broward is no longer a maintenance item an owner replaces in kind when it fails. Once the work crosses into substantial repair, the elevation standard applies, and a wall that has to end up two feet taller than the old one is a different structure with different loads, a different retained height and often a different foundation. The cheapest way to handle that is to know it before the old wall is demolished.

What Raising a Seawall Actually Changes

Height is the visible part. What moves underneath it is the part that decides whether the wall lasts.

  • Retained height goes up, so lateral earth pressure goes up with the square of it
  • Required embedment below the mudline increases, which can outrun what the existing sheet can reach
  • A wall that worked as a cantilever may now need a tieback or a deadman anchor system
  • The cap and any new sheet have to be detailed for the final elevation, not the interim one
  • Adjacent structures within the active wedge behind the wall become part of the analysis
  • Drainage behind the wall matters more, because a taller wall holds a taller column of water

The Ground Behind the Wall

Broward waterfront lots are frequently dredge and fill, cut from wetland and mangrove and raised with what came out of the canal. That history sits directly behind the seawall and directly under the house.

What Actually Governs a Structure in Fort Lauderdale

Six variables move from one address to the next across Florida. In Broward, five of them sit near the extreme end of their range and the sixth is administered by a body that exists nowhere else in the state.

The first is the High Velocity Hurricane Zone. Miami-Dade and Broward are the only two Florida counties inside it. The code applies a separate set of provisions, and assemblies have to carry approvals earned under the local test protocols rather than a general manufacturer listing. A detail that permits without comment in Palm Beach County can be rejected on this side of the county line.

The second is the Broward County Board of Rules and Appeals. Broward publishes its own set of local amendments to the Florida Building Code, hears appeals of decisions made by building and fire code officials, renders formal interpretations of disputed code sections, and certifies the code professionals working in the county. An engineer who knows the Florida Building Code but not the Broward amendments is working from an incomplete book, and finding that out at plan review is expensive.

The third is wind speed and exposure. Broward sits near the top of the statewide range, and pressure rises with the square of design speed, so the difference between here and inland Florida is far larger than the numbers look. Exposure then modifies it again. A house facing the Intracoastal and a house four blocks inland can share a design speed and carry meaningfully different loads.

The fourth is flood. Fort Lauderdale is low, flat, and drained by a canal network that backs up on a high tide, which is why tidal flooding shows up here on clear days. In a coastal high hazard zone the lowest horizontal structural member has to sit above the design flood elevation and enclosures below it have to be built to give way. The substantial improvement threshold then decides whether a renovation quietly becomes a full code upgrade.

The fifth is the ground, which on the waterfront means fill over organics over rock, and the sixth is the age of the building stock. Broward carries a large inventory of mid rise and high rise buildings now old enough to fall under both the statewide milestone inspection requirement and the county building safety inspection program that Broward has administered for decades. Those two run alongside each other rather than one replacing the other.

Milestone Inspections and Building Safety

Under the statewide requirement, residential condominium and cooperative buildings three habitable stories or more in height come due for a milestone inspection when the building reaches thirty years of age. A local enforcement agency may pull that forward to twenty five years where local conditions such as proximity to salt water warrant it, and in a county with this much waterfront that matters. After the first inspection the cycle repeats every ten years. One to four family dwellings with three or fewer habitable stories above ground are not covered.

Broward County also runs its own building safety inspection program, administered through the Board of Rules and Appeals, and it predates the state requirement by decades. Where both apply they do not cancel each other out, and the forms, the filing path and the review are not identical. We confirm in writing which requirement the authority having jurisdiction is enforcing for the specific property before scoping anything, because guessing between two overlapping programs is how a board ends up paying for the wrong report.

A milestone inspection is an engineering finding, not a document to obtain. Phase one is visual. If substantial structural deterioration is found, phase two follows and can involve testing, exposure of concealed elements, and a defined repair program. The reserve conversation and the assessment conversation both follow from what phase two measures, which is why the testing scope deserves far more attention than it usually gets.

Criteria First, Then Drawings

Most of the expensive surprises on a Broward project are not engineering failures. They are sequencing failures. An owner demolishes a seawall and then learns the replacement has to be two feet taller. An architect sets a floor elevation the flood map will not allow. A board budgets a concrete repair against a damaged area that turns out to be a third of the real one. In every case the information that would have prevented it was available before the money was committed.

We work the other direction.
