Why FishHawk Foundations Are a Diagnosis Problem

FishHawk is an unincorporated community and census designated place in Hillsborough County, about 20 miles southeast of downtown Tampa, bordered on the north by the Alafia River. It covers 16.4 square miles. There is no city hall here. Hillsborough County permits and inspects everything.

Almost none of it existed thirty years ago. FishHawk Ranch, a master planned community of more than 3,000 acres, was developed by Newland Communities beginning in the 1990s, and FishHawk Trails was built by a separate company over the same period. Starling at FishHawk and The Preserve came later, on land that had been undeveloped wildlife habitat. The census tells the rest of it: 1,991 residents in 2000, 14,087 in 2010, and 24,625 in 2020.

That means the housing stock here sits in one narrow age band. Nearly every roof in FishHawk went on between the mid 1990s and today, on ground that was cleared, graded, filled and compacted to turn ranch and timber land into subdivisions. That produces one kind of foundation problem. Fill and the soils beneath it consolidate under new load, and where a corner was cut during a fast build out, it surfaces as differential movement years later. Because whole streets went up under one builder in one phase, when it surfaces it often surfaces on more than one house.

Then there is the other kind, and this is the part most contractors will not raise with you. Hillsborough County sits in what geologists call Sinkhole Alley, along with Pasco and Hernando. The reason is not that there is limestone underneath, because there is limestone under all of Florida. It is that the Hawthorn Group, the clay and phosphatic sand layer that caps the limestone, has been partially stripped away across this county. Where the cap is entirely gone, ground tends to sag slowly into a shallow bowl. Where it is fully intact, very little happens at all. Where it is partial, a cohesive clay layer can bridge over a growing void for years and then let go at once. That is a cover collapse, and it is the type that makes the news.

Two events inside fifteen miles of FishHawk show what that looks like. In January 2010 temperatures fell below freezing twice over seven days, bottoming near 25 degrees, and growers in the Dover and Plant City area to the north pumped groundwater hard to protect their crops. Aquifer levels dropped sharply. Over roughly the following twenty days, 130 sinkholes were reported and 806 dry well complaints came in. In February 2013 in Seffner, around ten miles north of here, a cover collapse opened under a house overnight, took a bedroom and the man asleep in it, and the home was demolished. That hole reopened in 2015 and again in July 2023.

None of that is said to alarm anybody. It is said because a crack in a FishHawk slab can come from the fill or from what is happening underneath the fill, the two can look nearly identical on the drywall, and the difference decides everything that happens next.

In most of Florida, whether a crack is settlement or sinkhole activity is a technical question. In Hillsborough County it is also a financial one, because state law treats the two very differently.

Every property insurance policy issued in Florida must include catastrophic ground cover collapse at no extra cost. But that coverage carries four conditions and all four have to be met: the ground cover has to collapse abruptly, there has to be a depression clearly visible to the naked eye, there has to be structural damage to the building including the foundation, and the structure has to be condemned and ordered vacated by a government agency. Settling and cracking on their own do not qualify.

Coverage for sinkhole loss, meaning structural damage caused by sinkhole activity without that entire sequence, is optional. An insurer may offer it for an additional premium, with a deductible of 1, 2, 5 or 10 percent of the dwelling limit. Plenty of homeowners here do not carry it and have never been told they do not.

So the order matters. Establish what is moving and why, in writing, before anyone quotes a repair. Read the policy for the sinkhole endorsement. Then decide. Doing it the other way around is how people pay out of pocket for something that was covered, or wait months on a claim that was never going to be paid.

Sometimes the answer is clear at the first visit. Sometimes it takes borings. What it never takes is a guess from a salesman holding a pier brochure.

Why do so many FishHawk homes seem to be the same age?

Because they are. The population went from 1,991 in 2000 to 14,087 in 2010 to 24,625 in 2020, and almost the entire community was built inside that window. That matters practically, because when a builder or a phase produced a systemic problem, it tends to appear on several houses along the same street rather than on one.

Does my insurance cover foundation damage?

It depends on the cause and on what your policy includes, and the two are not the same question. Florida law requires every property policy to include catastrophic ground cover collapse at no additional cost, but that requires all four of an abrupt ground cover collapse, a depression clearly visible to the naked eye, structural damage to the building including the foundation, and the structure being condemned and ordered vacated by a government agency. Ordinary settling and cracking do not meet it. Sinkhole loss coverage, which addresses structural damage from sinkhole activity without that sequence, is optional and carries its own deductible.
